Welcome to ELK Promotions. By accessing or using our website and purchasing our products, you agree to be bound by the following Terms and Conditions. Please read them carefully before placing an order.

1. Made-to-Order & No-Return Policy

All items sold on our website are strictly made-to-order. Because each piece is custom-manufactured specifically for you, we do not accept returns, cancellations, or exchanges for buyer’s remorse, incorrect size selection, or change of mind.

1.1 Damaged or Defective Items

If your item arrives damaged or defective due to a manufacturing error, please contact us within 7 days of delivery. You must provide your order number and clear photographic evidence of the damage. If approved, we will issue a replacement or refund at our expense.

1.2 Discretionary Exceptions

ELK reserves the right, at our sole discretion, to honor a return or exchange on a case-by-case basis for exceptional circumstances. If an exception is granted:

  • The customer is entirely responsible for all return shipping costs.

  • Items must be returned in their original, unworn, and unwashed condition.

  • Refunds of outbound shipping charges for the original shipment will not be provided.

2. Shipping, Delivery, and Lost/Stolen Packages

ELK is proud to craft your custom pieces, but our liability ends once the package leaves our hands and is marked as delivered by the carrier.

  • Lost or Stolen Packages: ELK is not responsible for lost or stolen products once the carrier marks the tracking status as "Delivered."

  • Mis-Delivery Claims: If your package is marked as delivered but you have not received it, any mis-delivery claims must be initiated and handled directly by the client with the respective shipping carrier.

  • Our Support: While we cannot resolve carrier errors ourselves, ELK will gladly help provide tracking documentation, proof of shipment, and any other necessary information to assist you in the claims process.

3. Orders and Pricing

  • Order Acceptance: We reserve the right to refuse or cancel any order at any time for reasons including but not limited to: product availability, errors in the description or price of the product, or error in your order.

  • Pricing Changes: Prices for our products are subject to change without notice.

  • Accuracy of Billing: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

4. Intellectual Property

All content included on this site, such as text, graphics, logos (other than the WFA logo), images, digital downloads, and custom apparel designs, is the property of ELK and is protected by international copyright, trademark, and intellectual property laws. You may not reproduce, duplicate, copy, or exploit any portion of our designs or website without express written permission from us.

5. Limitation of Liability

To the maximum extent permitted by law, ELK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our website or products.

6. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of State of Ohio, United States.

7. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
